Is Aster Available in the EU? Terms and Registers

The short answer

MiCA or MiFID II?

Perpetual futures are derivatives, so they fall under existing EU financial-services law (MiFID II) rather than MiCA, which covers crypto-assets that are not already financial instruments. A venue that is authorised under neither sits outside the EU perimeter entirely — no MiFID conduct rules, no complaints route, no compensation scheme. What Aster's Terms say

Read at docs.asterdex.com · Terms & Conditions (page states "Last updated: February 25, 2026"):

The Services are not available to, and you are expressly prohibited from using them if you reside in, are located in, are incorporated in, or have a registered office or principal place of business in any of the following jurisdictions (each a "Prohibited Jurisdiction"): the United States of America, Canada, the United Kingdom, China, North Korea, Russia, Ukraine, Cuba, Iran, Venezuela, or Syria. This prohibition extends to any jurisdiction or territory that is subject to comprehensive country-wide or regional economic sanctions or has been designated as "terrorist supporting" by the United Nations or the governmental authority of the European Union, United Kingdom, or the United States.

The name search returns unrelated names containing "aster" (e.g. MASTERINVEST, Faster Andelskasse). The only one with Aster as a separate word, ASTER CAPITAL PARTNERS SAS, is registered with France's AMF as an AIFM in Paris, with no website or commercial name on the record; nothing in the register links it to Aster DEX, whose Terms name no legal entity.

ESMA does not maintain a single EU-wide register of investor warnings; national competent authorities publish their own lists, and the IOSCO investor-alerts portal that aggregates them could not be queried by this site's tooling on the check date. No national warning list was searched. "No entry" above means no entry in the three ESMA registers named, nothing more.
